Listaurante Terms of Service

These Terms of Service ("Terms") govern your use of all services provided by us under the name Listaurante ("Service"). By using the Service, you agree to these Terms.
Article 1 β Scope of Terms
These Terms apply to all users of the Service. If any provision conflicts with applicable law, that provision shall not apply, and the remaining provisions shall remain in effect.
Article 2 β Definitions
- Service: The mobile application, website (listaurante.jp and its subdomains), and all related services operated by us
- App: The mobile application provided by us
- Site: The website operated by us (listaurante.jp)
- User: Any person who uses the Service
- Registered User: A user who has created an account
- Posted Content: Text, images, location data, ratings, notes, and other content posted by users on the Service
- Public Post: Posted content that the user has set to public
- Personal Record: Posted content that the user has set to private
- Paid Features: Fee-based features and services provided under separately defined conditions (not currently available; users will be notified when introduced)
Article 3 β Agreement to Terms
Please read these Terms and the Privacy Policy carefully before using the Service. By using the Service, users are deemed to have validly and irrevocably agreed to these Terms and the Privacy Policy. If you do not agree, you may not use the Service.
If a user is a minor, please obtain consent from a parent or legal guardian before use. If a minor uses the Service without such consent, or provides false information regarding age or legal capacity, the user shall not be able to rescind any legal acts related to the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms. We will endeavor to notify users of significant changes through appropriate means within the Service.
Article 4 β Technical Requirements
Use of the Service requires an internet connection. Data charges are the responsibility of the user. We do not guarantee compatibility with all devices, operating systems, or browsers.
Article 5 β Personal Information
Personal information and user data are handled in accordance with our separately defined Privacy Policy.
Article 6 β Account Registration
- Registered users must provide accurate and up-to-date information.
- Users are responsible for managing their account and password.
- Transferring, lending, or sharing accounts with third parties is prohibited.
- Please contact us immediately if you discover unauthorized use of your account.
- We are not responsible for any damages resulting from unauthorized account use.
Article 7 β User Responsibilities and Prohibited Conduct
Users use the Service at their own responsibility and bear full responsibility for their posted content. The following actions are prohibited:
- Violating laws or public order and morals
- Engaging in or facilitating criminal activity
- Damaging or interfering with our servers or networks
- Obstructing the operation of our Service
- Collecting or storing personal information of other users or third parties
- Impersonating other users
- Providing benefits to antisocial forces
- Defaming or making inappropriate statements about individuals, corporations, or establishments
- Spamming, multi-posting, or other nuisance behavior
- Using the Service for commercial purposes without authorization
- Reverse engineering, decompiling, or disassembling the Service
- Collecting data using automated tools (bots, scraping, etc.)
- Posting false or misleading information
- Any other action we deem inappropriate
Article 8 β User-Generated Content
- By posting content on the Service, users grant us a license to use it for the following purposes:
- Display and distribution on the Service (app and website)
- Search engine indexing and SEO purposes
- Generation and distribution of OGP images and metadata for social sharing
- Service improvement and feature development
- Advertising, promotion, and marketing
- Statistical and analytical purposes
- This license is non-exclusive, royalty-free, and worldwide. Content may remain for a period after deletion due to technical reasons (cache, backups, etc.).
- Content set to "Public" will be published on the Site and may be indexed by search engines including Google, making it viewable by anyone. Users acknowledge this when choosing to make a public post.
- Users warrant that their posted content does not infringe the rights (copyright, portrait rights, privacy rights, etc.) of any third party.
- We bear no responsibility for backup, storage, or restoration of posted content.
Article 9 β Social Features
- The Service includes social features such as public profiles, timelines, and list functions.
- Content set to public is viewable by other users and visitors to the Site.
- Users shall respect other users' content and communicate appropriately.
- We are not responsible for disputes between users arising from social features.
- We may restrict or delete accounts of users who repeatedly engage in harmful behavior, without prior notice.
Article 10 β Restrictions on Chain Restaurant Posts
We place importance on ensuring that user-posted content aligns with the purpose and values of the Service. Based on this policy, posts about certain chain restaurants (nationally operating food and beverage brands, etc.) may not be eligible for "public posting" viewable by other users. In such cases, users may still save the record as a "personal record." This restriction is not intended to defame any specific company or establishment, but reflects our operational policy based on our concept: recording and sharing hidden gem restaurants and favorite spots you'd want to quietly recommend to friends.
Article 10-2 β No Sale of User Data
We do not sell users' personal information, behavioral data, or meal record data to third parties. Third-party data sharing is limited to the cases described in Article 9 of the Privacy Policy.
Article 11 β Paid Features and Billing
- We may offer paid premium features, subscriptions, and other fee-based services in the future.
- Pricing, terms, and cancellation procedures for paid features will be announced separately when introduced.
- In-app purchases are processed through the Apple App Store, and refunds are handled according to Apple's policies.
- Except as required by law, we do not provide refunds for paid fees.
- We may change the content or pricing of paid features without prior notice, though we will endeavor to notify users of significant changes in advance.
Article 12 β AI Features
- We may offer AI features in the future that analyze and leverage users' meal record data (dietary insights, restaurant recommendations, photo analysis, etc.).
- In using AI features, users' meal records, location data, and behavioral history may be processed by our systems or affiliated AI service providers.
- When AI features are introduced, we will update these Terms and the Privacy Policy and notify users accordingly.
- Results and recommendations from AI features are for reference only; we do not guarantee their accuracy or completeness.
Article 13 β Service Provision
- We may change, suspend, or terminate all or part of the Service without prior notice when we deem it necessary.
- Access to the Service may be restricted based on age or other criteria.
- Users acknowledge in advance that the Service may contain advertisements.
- We do not warrant that the Service is free from factual or legal defects.
Article 14 β Disclaimer
- We are not liable for any damages arising from changes, suspension, or termination of the Service.
- We do not guarantee the accuracy, legality, or completeness of posted content.
- We are not liable for any direct or indirect damages arising from a user's use of the Service.
- We are not responsible for third-party external services or advertising content.
- In the event of disputes between users, both parties shall resolve them independently, and we will not be involved.
- If a user causes damage to a third party, the user shall resolve it at their own cost and responsibility.
- If a user causes damage to us, the user shall compensate us for all damages (including attorney's fees).
Article 15 β Withdrawal and Account Deletion
- Users may request withdrawal or account deletion at any time.
- Upon withdrawal, personal record data will be deleted. Public post content is handled in accordance with Article 8.
- We may delete accounts without prior notice if unauthorized use or violation of these Terms is found.
- Some data may remain after account deletion for technical reasons (see Privacy Policy).
Article 16 β Assignment of Rights
- Users may not transfer or assign their rights or obligations under these Terms to a third party without our prior written consent.
- We may transfer or sell all or part of the Service to a third party at our discretion. In such cases, users' rights will be transferred to the successor.
Article 17 β Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan.
Article 18 β Jurisdiction
In the event of a dispute between us and a user, the Tokyo Summary Court or the Tokyo District Court shall have exclusive jurisdiction.
